Validity of EU Regulation 261/2004
According to EU Regulation 261/2004, you as a passenger are entitled to a number of rights.

The regulation applies:
- for passengers departing from an EU member state or from a third country on a flight with an EU airline to an EU country, unless they have received re-routing or compensation and assistance in that third country.
- only if you have a confirmed booking for the flight in question.
- Only if you have arrived at the check-in desk by the specified check-in deadline or, if no time has been specified, at least 45 minutes before the published departure time (except in the case of flight cancellation)
The regulations do not apply:
- For passengers traveling free of charge or at a reduced fare that is not available directly or indirectly to the general public.
According to EU Regulation 261/2004, you are entitled to certain care services from the airline in the event of delays in departure that are reasonably foreseeable in relation to the scheduled departure time:
- from four hours for flights over 3,500 km,
- three hours for flights between 1,500 and 3,500 km and flights over 1,500 km within the EU,
- two hours for flights up to 1,500 km.
- Meals in reasonable proportion to the waiting time
- If necessary, hotel accommodation with possible transfer
- The possibility of two telephone calls, telex, fax, or e-mails
Please note: Assistance services do not have to be provided if they would further delay your departure.
In the event of delays of more than 5 hours, you have the right to cancel your flight and receive a refund for the cost of the flight ticket and any unused parts of the journey, or to exercise your further rights in accordance with Article 8(1)(a) of EU Regulation 261/2004.
This is subject to you being able to demonstrate that the purpose of your journey has been lost.
Please note: For package tours, the conditions of the Package Travel Directive (90/314/EEC) apply. This means that you may incur very high cancellation costs if you cancel.
If LEAV Airlines has offered you a voluntary cancellation of your flight or you are involuntarily denied boarding on your booked flight, you are entitled to care services and compensation payments.
You will also be offered alternative transportation to the final destination of your booked flight. This alternative transportation will be provided at the earliest possible time and under comparable conditions. Subject to availability, you may also travel to your final destination at a later time of your choosing, but you will then have to bear the costs of meals, hotel, and transfer yourself.
In the event of delays of three hours or more, you are entitled to compensation in accordance with ECJ rulings C-581/10 and C-629/10 in the form of cash, check, bank transfer, or, with your consent, a voucher.
The amount of the payment depends on the distance of the planned flight route:
- €250 for flights up to 1,500 km,
- €400 for flights between 1,500 and 3,500 km and for flights within the EU over 1,500 km,
- €600 for flights over 3,500 km.
Please note: You are not entitled to compensation if the delay is due to extraordinary circumstances. Furthermore, in accordance with the judgments of the European Court of Justice in cases C 402/07 and C 432/07, this compensation may be reduced by 50% if the delay is less than 4 hours.
In the event of involuntary denied boarding, you are also entitled to compensation in the form of cash, check, bank transfer, or, with your consent, a voucher.
The amount of compensation depends on the distance of the planned flight:
- $250 for flights up to 1,500 km,
- €400 for flights between 1,500 and 3,500 km and for flights within the EU over 1,500 km,
- €600 for flights over 3,500 km.
If you are offered an alternative flight, the following reduced compensation payments may apply:
- €125 for flights of up to 1,500 km, if the arrival time of the alternative flight is no later than two hours after the scheduled arrival time of the originally booked flight,
- €200 for flights between 1,500 and 3,500 km and flights within the EU over 1,500 km, if the arrival time of the alternative flight is no later than three hours after the scheduled arrival time of the originally booked flight
- €300 for flights over 3,500 km, if the arrival time of the alternative flight is not later than four hours after the scheduled arrival time of the originally booked flight.
If your flight is canceled and you have a confirmed booking, we will inform you about possible alternative transportation. You are also entitled to assistance, reimbursement, and compensation as listed above.
You are not entitled to compensation in the event of cancellation if we:
- inform you of the cancellation at least 14 days before the scheduled departure,
- inform you of the cancellation between 14 and 7 days before the scheduled departure and offer you an alternative flight at the same time, departing no more than two hours before the original departure time and arriving no more than four hours after the scheduled arrival time;
- inform you of the cancellation less than 7 days before the scheduled departure and offer you an alternative flight at the same time, with a departure time no more than one hour before the original departure time and no more than two hours after the scheduled arrival time.
If your flight was canceled due to extraordinary circumstances, you are not entitled to compensation.
